1. Acceptance of Terms

By downloading, installing, or using NUUM ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1.1 Agreement

• These Terms constitute a legally binding agreement between you and NUUM
• You must be at least 13 years old to use the App
• If you're under 18, you need parental consent
• You represent that you have the authority to agree to these Terms

2. Description of Service

2.1 What NUUM Does

NUUM is an AI-powered fashion stylist app that:

• Analyzes outfit photos using artificial intelligence (GPT-4 Vision)
• Provides fashion feedback, ratings, and styling advice
• Stores your outfit history (if you create an account)
• Offers free and premium subscription tiers

2.2 Service Availability

• No Guarantee: We strive for 24/7 availability but do not guarantee uninterrupted service
• Maintenance: Service may be temporarily unavailable for updates or maintenance
• Changes: We may modify, suspend, or discontinue features at any time
• Notice: We will provide reasonable notice for significant changes

3. User Accounts

3.1 Account Creation

• Optional: You can use NUUM without creating an account (guest mode)
• Required Information: Email address for account creation
• Accuracy: You must provide accurate information
• Security: You're responsible for maintaining account security

3.2 Account Responsibilities

• Keep your password confidential
• Notify us immediately of unauthorized access
• You're responsible for all activity under your account
• Do not share your account with others

3.3 Account Termination

• Your Right: You can delete your account anytime (Settings → Delete Account)
• Our Right: We may suspend or terminate accounts that violate these Terms
• Effect: Termination results in loss of access to your data
• Refunds: See Section 5 for refund policies

4. Free and Premium Services

4.1 Free Tier

• Daily Limit: 3 outfit analyses per day
• Features: Full AI analysis, outfit history, all core features
• Reset: Daily limit resets at midnight (your device timezone)
• Changes: We may modify free tier limits with notice

4.2 NUUM Pro (Subscription)

• Benefits: Unlimited outfit analyses, priority processing, advanced features
• Plans: Monthly or Yearly subscription
• Platform: Subscriptions managed through Apple App Store
• Terms: Subject to Apple's Terms and Conditions

5. Payments and Subscriptions

5.1 Pricing

• Display: Prices shown in the App are in your local currency
• Taxes: Prices may not include applicable taxes
• Changes: We may change prices with 30 days notice
• Existing Subscribers: Price changes don't affect active subscriptions until renewal

5.2 Billing

• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Billing Date: You'll be charged on your subscription anniversary
• Payment Method: Through your Apple ID payment method
• Failed Payment: Service may be suspended if payment fails

5.3 Cancellation

• How to Cancel: Via App Store Subscriptions in iOS Settings
• Timing: Cancel at least 24 hours before renewal to avoid charges
• Access: You retain access until the end of the current billing period
• No Partial Refunds: Cancellation does not entitle you to a refund for unused time

5.4 Refunds

• Apple Policy: Refund requests handled by Apple
• How to Request: Through App Store (reportaproblem.apple.com)
• Our Policy: We do not provide refunds except as required by law
• Exceptions: Technical issues preventing service use may qualify for refunds

5.5 Free Trials

If we offer a free trial:

• You must cancel before trial ends to avoid charges
• One free trial per user
• We reserve the right to revoke free trials if abused

6. Acceptable Use

6.1 Permitted Use

You may use NUUM for:

• Personal, non-commercial outfit analysis
• Fashion advice and guidance
• Learning about style and fashion principles

6.2 Prohibited Use

You may NOT:

• Inappropriate Content: Upload illegal, harmful, or offensive images
• Abuse: Attempt to circumvent daily limits or exploit the service
• Reverse Engineering: Decompile, reverse engineer, or extract the app's code
• Automation: Use bots or automated tools to access the service
• Resale: Resell or redistribute the app or its content
• Impersonation: Impersonate others or provide false information
• Interference: Interfere with or disrupt the service
• Data Mining: Extract or collect data from the service

6.3 Content Guidelines

• Appropriate Photos: Only upload photos of clothing/outfits
• No Nudity: Do not upload inappropriate or explicit content
• Respectful Use: Use the service in a respectful manner
• Legal Compliance: Ensure uploaded content complies with laws

6.4 Consequences of Violation

• Immediate termination of account
• Loss of access to service
• No refund of subscription fees
• Legal action if applicable

7. Intellectual Property

7.1 Our Rights

• App Ownership: NUUM owns all rights to the app, including design, code, and branding
• Trademarks: "NUUM" and related marks are our trademarks
• Copyright: All content created by NUUM is copyrighted
• Protection: Unauthorized use of our IP may result in legal action

7.2 Your Rights

• Your Photos: You retain ownership of photos you upload
• License to Us: You grant us a license to process your photos for analysis
• AI Feedback: Analysis results are for your personal use
• Sharing: You may share your results on social media

7.3 AI-Generated Content

• Fashion advice is generated by AI (GPT-4 Vision)
• You may use AI-generated advice for personal purposes
• We do not claim ownership of advice given to you
• AI content is provided "as-is" without guarantees

8. Disclaimers and Limitations

8.1 No Fashion Expertise Guarantee

• AI-Powered: Advice is generated by artificial intelligence
• Not Professional: NUUM does not replace professional fashion consultants
• Subjective: Fashion is subjective; our advice is one perspective
• No Guarantees: We don't guarantee accuracy or suitability of advice

8.2 Service Disclaimers

• "AS-IS" Service: The app is provided "as-is" without warranties
• No Warranty: We don't warrant uninterrupted, error-free, or secure service
• Results: We don't guarantee specific results from using the app
• Compatibility: We don't guarantee compatibility with all devices or OS versions

8.3 Third-Party Services

• We use third-party services (OpenAI, Firebase, Apple)
• We're not responsible for third-party service failures
• Third-party terms and policies apply

8.4 Limitation of Liability

• Maximum Liability: Our liability is limited to the amount you paid in the last 12 months
• Indirect Damages: We're not liable for indirect, incidental, or consequential damages
• Lost Data: We're not liable for loss of data or content
• Third Parties: We're not liable for actions of third-party services

8.5 Exceptions

Some jurisdictions don't allow liability limitations. In such cases, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold NUUM harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any laws or rights of third parties
• Content you upload to the service
• Your use of the service

10. Privacy and Data

• Incorporation: The Privacy Policy is part of these Terms
• Consent: Using NUUM means you consent to our Privacy Policy

11. Changes to Terms

11.1 Modifications

• Right to Change: We may modify these Terms at any time
• Notice: Significant changes will be announced in the app
• Effective Date: Changes take effect when posted
• Continued Use: Using the app after changes means you accept new Terms

11.2 Disagreement

• If you disagree with new Terms, stop using the app
• Cancel your subscription if applicable
• Delete your account if desired

12. Termination

12.1 By You

• You may stop using NUUM anytime
• Delete your account in Settings
• Cancel subscriptions through App Store

12.2 By Us

• We may suspend or terminate your access for Terms violations
• We may discontinue the service with reasonable notice
• Termination doesn't entitle you to refunds (except as required by law)

12.3 Effect of Termination

• Loss of access to your account and data
• Deletion of your content after 30 days
• No refund of unused subscription time
• Survival of certain provisions (indemnification, limitations, etc.)

13. Dispute Resolution

13.1 Informal Resolution

• We'll work in good faith to resolve issues

13.2 Governing Law

• These Terms are governed by the laws of Ukraine
• Disputes will be resolved in courts of Ukraine
• You consent to exclusive jurisdiction in these courts

13.3 Arbitration (If Applicable)

Depending on your jurisdiction, disputes may be resolved through arbitration rather than courts.

14. General Provisions

14.1 Entire Agreement

• These Terms and the Privacy Policy constitute the entire agreement
• Supersedes any prior agreements or understandings

14.2 Severability

• If any provision is found invalid, the rest remains in effect
• Invalid provisions will be modified to be enforceable

14.3 No Waiver

• Failure to enforce a provision doesn't waive our right to enforce it later

14.4 Assignment

• We may assign these Terms to another company
• You may not assign your rights without our consent

14.5 Force Majeure

• We're not liable for failures due to circumstances beyond our control
• Examples: natural disasters, wars, pandemics, government actions

15. App Store Terms

15.1 Apple Requirements

• Downloaded from Apple App Store, subject to Apple's terms
• Apple is not responsible for the app or its content
• Apple is not obligated to provide support
• In case of warranty failures, contact us (not Apple)

15.2 Apple as Third-Party Beneficiary

• Apple is a third-party beneficiary of these Terms
• Apple may enforce these Terms against you
